California CodesBusiness and Professions Code - BPCDivision 8 — Special Business RegulationsChapter 12 — Precious Metal MarkingArticle 2 — The Platinum GroupSection 22131
In any action relating to the enforcement of any provision of this article, proof that an article has been marked in violation of the provisions of this article shall be deemed to be prima facie proof that such article was manufactured after this article became effective.
Notes
Establishes that, in an action enforcing the article, proof that an article was marked in violation of the article is prima facie proof that the article was manufactured after the article became effective. The evidentiary presumption concerns manufacturing timing and does not make the improper mark conclusive proof or create a separate penalty.
