The department may on its own motion at any time before a penalty assessment is placed into effect, and without any further proceedings, review the penalty, but such review shall be limited to its reduction.
Notes
Allows the department, before a penalty assessment becomes effective, to review the assessment on its own motion without further proceedings. Limits that review authority to reducing the penalty; the provision does not authorize the department through this review to increase the assessment or otherwise modify it beyond a reduction.
