This article shall apply to the following:
(a) An attorney who is an active licensee of the State Bar who provides immigration reform act services.
(b) An attorney who is not an active licensee of the State Bar, but who meets both of the following:
(1) The attorney is authorized by federal law to practice law and to represent persons before the Board of Immigration Appeals or the United States Citizenship and Immigration Services.
(2) The attorney is providing immigration reform act services in an office or business in California.
Notes
Sets the article to apply to active State Bar attorneys who provide immigration reform act services and to attorneys who are not active State Bar licensees when both specified conditions are met. The latter must be federally authorized to practice and represent persons before the named federal immigration bodies and provide those services from a California office or business.
