California Codes, Business and Professions Code - BPC, Division 3 — Professions and Vocations Generally, Chapter 21.5 — Foreign Labor Contractors, Section 9998
This chapter shall apply only to the following:
(a) Nonagricultural workers under the federal H-2B visa program established pursuant to Section 101(a)(15)(H)(ii)(b) of the federal Immigration and Nationality Act (8 U.S.C. Sec. 1101(a)(15)(H)(ii)(b)).
(b) On and after July 1, 2027, agricultural workers under the federal H-2A visa program established pursuant to Section 101(a)(15)(H)(ii)(a) of the federal Immigration and Nationality Act (8 U.S.C. Sec. 1101(a)(15)(H)(ii)(a)).
Notes
Limits the chapter to nonagricultural workers under the federal H-2B visa program and, beginning July 1, 2027, agricultural workers under the federal H-2A visa program. The provision expressly defines the worker populations covered by the chapter and delays application to H-2A agricultural workers until the stated date.
