In any action under Section 14493 it is not necessary to allege or prove actual damages or the threat thereof or actual injury or the threat thereof, to the plaintiff, but in addition to injunctive relief, any plaintiff in any such action is entitled to recover the amount of the actual damages, if any, sustained by such plaintiff.
Notes
Allows a plaintiff seeking relief for unauthorized organizational-name use to obtain an injunction without alleging or proving actual damages, threatened damages, actual injury, or threatened injury. In addition to injunctive relief, the plaintiff may recover any actual damages sustained, so lack of proof of injury does not bar the injunction but limits damages to those actually sustained.
