California CodesBusiness and Professions Code - BPCDivision 9 — Alcoholic BeveragesChapter 1.5 — AdministrationArticle 4 — Appeals From Decisions of the DepartmentSection 23082

No decision of the department shall become effective during the period in which an appeal may be filed and the filing of an appeal shall stay the effect of the decision until such time as a final order is made by the board.

Notes

Bars a department decision from becoming effective during the period in which an appeal may be filed. If an appeal is filed, requires the decision effect to remain stayed until the Alcoholic Beverage Control Appeals Board makes its final order, so both the appeal period and pending appeal postpone effectiveness.
