California CodesCalifornia Constitution - CONSArticle I — Declaration of RightsSection 14.1

If a felony is prosecuted by indictment, there shall be no postindictment preliminary hearing.

Notes

Bars a postindictment preliminary hearing when a felony is prosecuted by indictment. Once the felony case proceeds through an indictment, the provision eliminates the additional preliminary-hearing stage after that indictment and applies specifically to a felony prosecuted in that manner.
