U.S. Constitution, Eighth Amendment

Bail, Fines, and Punishment

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Notes

Bars requiring excessive bail, imposing excessive fines, or inflicting cruel and unusual punishments. The prohibition covers three separate things: the amount of bail that may be required, the size of fines that may be imposed, and the kind of punishment that may be inflicted.
