An offer of performance must be made by the debtor, or by some person on his behalf and with his assent.
Notes
Requires an offer of performance to be made by the debtor or by another person acting on the debtor’s behalf and with the debtor’s assent. An offer made by someone without the debtor’s authorization or assent does not satisfy this requirement for a valid tender of performance.
