California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 5 — Extinction of Contracts, Chapter 3 — Modification and Cancellation, Section 1701

Where a contract is executed in duplicate, an alteration or destruction of one copy, while the other exists, is not within the provisions of the last section.

Notes

Exempts alteration or destruction of one copy of a contract executed in duplicate from the rule extinguishing executory obligations when the other copy continues to exist. The exception applies because an intact duplicate remains available despite the change to or destruction of one counterpart.
