California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.7 — Consumer Warranties, Chapter 1 — Consumer Warranty Protection, Article 1 — General Provisions, Section 1790.1

Any waiver by the buyer of consumer goods of the provisions of this chapter, except as expressly provided in this chapter, shall be deemed contrary to public policy and shall be unenforceable and void.

Notes

Bars a buyer of consumer goods from waiving provisions of the chapter except where the chapter expressly allows a waiver. Any other attempted waiver is deemed contrary to public policy, unenforceable, and void, so the buyer cannot contract away chapter requirements or protections unless the chapter itself specifically authorizes that waiver.
