California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 3 — Of the Parties to Civil Actions, Chapter 3 — Disability of Party, Section 375

An action or proceeding does not abate by the disability of a party. The court, on motion, shall allow the action or proceeding to be continued by or against the party’s representative.

Notes

Requires an action or proceeding to continue despite a party's disability and, on motion, to proceed by or against the party's representative. The disability therefore does not abate the matter, and the court must allow continuation through the appropriate representative when a motion is made.
