A refusal by a creditor to accept performance, made before an offer thereof, is equivalent to an offer and refusal, unless, before performance is actually due, he gives notice to the debtor of his willingness to accept it.
Notes
Establishes that a creditor’s advance refusal to accept performance has the same effect as an offer of performance followed by refusal. The rule does not apply if, before performance becomes due, the creditor notifies the debtor that the creditor is willing to accept the performance.
