California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 9 — Enforcement of Judgments, Division 4 — Third-party Claims and Related Procedures, Chapter 4 — Hearing on Third-Party Claim, Section 720.370
If the petition for a hearing was made by the third person, neither the petition nor the proceedings pursuant thereto may be dismissed without the consent of the creditor. If the petition for a hearing was made by the creditor, neither the petition nor the proceedings pursuant thereto may be dismissed without the consent of the third person.
Notes
Prohibits dismissal of a third person’s petition for a hearing, or proceedings on that petition, without the creditor’s consent. Conversely, when the creditor made the petition, the petition and resulting proceedings may not be dismissed without the third person’s consent, making dismissal dependent on the opposing specified person’s agreement.
