California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 14 — Of Miscellaneous Provisions, Chapter 6 — Of Costs, Section 1023

The fees of referees are such reasonable sum as the court may fix for the time spent in the business of the reference; but the parties may agree, in writing, upon any other rate of compensation, and thereupon such rates shall be allowed.

Notes

Requires the court to fix referee compensation at a reasonable amount based on time spent conducting the reference. Allows the parties to agree in writing to a different compensation rate, in which case the agreed rate must be allowed instead of the court-fixed reasonable sum that otherwise governs referee fees.
