California Codes, Code of Civil Procedure - CCP, Part 2 — Of Civil Actions, Title 14 — Of Miscellaneous Provisions, Chapter 6 — Of Costs, Section 1021

Except as attorney’s fees are specifically provided for by statute, the measure and mode of compensation of attorneys and counselors at law is left to the agreement, express or implied, of the parties; but parties to actions or proceedings are entitled to their costs, as hereinafter provided.

Notes

Allows attorney compensation to be fixed by the parties’ express or implied agreement except where statutes specifically provide for attorney fees, and establishes that parties to actions or proceedings are entitled to costs only as provided by law. The provision preserves statutory fee rules while otherwise leaving compensation to agreement.
