California Codes, Code of Civil Procedure - CCP, Part 3 — Of Special Proceedings of a Civil Nature, Title 3 — Of Summary Proceedings, Chapter 2.5 — Judicial Arbitration, Section 1141.13
This chapter shall not apply to any civil action which includes a prayer for equitable relief, except that if the prayer for equitable relief is frivolous or insubstantial, this chapter shall be applicable.
Notes
Exempts civil actions that include a prayer for equitable relief from the chapter, unless that prayer is frivolous or insubstantial. In that exception, the chapter applies despite the requested equitable relief, making the character of the equitable claim the stated dividing line for application of the chapter.
