California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 1 — Nature of a Contract, Chapter 3 — Consent, Section 1583

Consent is deemed to be fully communicated between the parties as soon as the party accepting a proposal has put his acceptance in the course of transmission to the proposer, in conformity to the last section.

Notes

Establishes that consent is fully communicated when the accepting party puts the acceptance into the course of transmission to the proposer in the manner permitted by the preceding communication rule. Completion of communication therefore occurs upon proper dispatch of the acceptance rather than upon the proposer’s actual receipt.
