California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 9 — Agency, Chapter 1 — Agency in General, Article 2 — Authority of Agents, Section 2305
Every act which, according to this Code, may be done by or to any person, may be done by or to the agent of such person for that purpose, unless a contrary intention clearly appears.
Notes
Allows an act that the Code permits to be done by or to a person to instead be done by or to that person’s agent for the purpose, unless a contrary intention clearly appears. The agent may therefore stand in for the person only under that stated condition.
