California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 9 — Agency, Chapter 1 — Agency in General, Article 2 — Authority of Agents, Section 2318

Every agent has actually such authority as is defined by this Title, unless specially deprived thereof by his principal, and has even then such authority ostensibly, except as to persons who have actual or constructive notice of the restriction upon his authority.

Notes

Establishes that an agent has the actual authority defined by the title unless the principal specially restricts it. Extends ostensible authority despite such a restriction, but exempts persons who have actual or constructive notice of the restriction, making notice of the principal's limitation controlling as to those persons.
