California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 9 — Agency, Chapter 1 — Agency in General, Article 4 — Obligations of Agents to Third Persons, Section 2342

One who assumes to act as an agent thereby warrants, to all who deal with him in that capacity, that he has the authority which he assumes.

Notes

Establishes that a person who assumes to act as an agent warrants to everyone dealing with that person in the claimed agency capacity that the asserted authority actually exists. Makes the assumption of an agent role itself carry that warranty of authority toward third persons who deal with the purported agent.
