California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 9 — Agency, Chapter 1 — Agency in General, Article 5 — Delegation of Agency, Section 2350
If an agent employs a sub-agent without authority, the former is a principal and the latter his agent, and the principal of the former has no connection with the latter.
Notes
Establishes that when an agent appoints a subagent without authority, the appointing agent becomes the principal of that subagent and the subagent becomes that agent's agent. Bars a direct agency connection under this rule between the unauthorized subagent and the original principal represented by the appointing agent.
