California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 7 — Carriage, Chapter 5 — Common Carriers, Article 3 — Common Carriers of Property, Section 2195

A common carrier is liable, even in the cases excepted by the last section, if his want of ordinary care exposes the property to the cause of the loss.

Notes

Establishes common-carrier liability even when a property loss falls within a listed exception to the carrier's ordinary liability if the carrier's lack of ordinary care exposed the property to the cause of loss. Makes the carrier's want of ordinary care the condition that overrides those otherwise applicable exceptions.
