California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 13 — Suretyship, Article 6 — Exoneration of Sureties, Section 2821

The rescission of an agreement altering the original obligation of a debtor, or impairing the remedy of a creditor, does not restore the liability of a surety who has been exonerated by such agreement.

Notes

Establishes that rescinding an agreement that altered a debtor's original obligation or impaired a creditor's remedy does not restore a surety's liability after that agreement already exonerated the surety. Keeps the surety discharged despite later rescission of the agreement that produced the exoneration.
