California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 1 — Liens in General, Article 4 — Priority of Liens, Section 2897

Other things being equal, different liens upon the same property have priority according to the time of their creation, except in cases of bottomry and respondentia.

Notes

Sets priority among different liens on the same property, when other things are equal, according to the time each lien was created. Earlier-created liens therefore take priority over later-created liens under this rule, except in cases involving bottomry and respondentia, which are expressly excluded from the time-of-creation priority rule.
