California Codes, Civil Code - CIV, Division 2 — Property, Part 2 — Real or Immovable Property, Title 3 — Rights and Obligations of Owners, Chapter 1 — Rights of Owners, Article 2 — Boundaries, Section 833

Trees whose trunks stand wholly upon the land of one owner belong exclusively to him, although their roots grow into the land of another.

Notes

Establishes that a tree whose trunk stands entirely on one owner’s land belongs exclusively to that owner, even if the tree’s roots extend into another person’s land. The provision bases ownership on the location of the trunk and states no separate ownership right for the neighboring landowner based on root growth.
