This chapter does not apply to any of the following:
(a) A power of termination conditioned upon the continued production or removal of oil or gas or other minerals.
(b) A power of termination as to separately owned improvements or fixtures conditioned upon the continued leasehold or possessory interest in the underlying land.
Notes
Exempts from the power-of-termination chapter a power conditioned on continued production or removal of oil, gas, or other minerals. It also exempts a power concerning separately owned improvements or fixtures when the power is conditioned on continuation of the leasehold or possessory interest in the underlying land.
