Section Fifteen Hundred and Twelve. If the performance of an obligation be prevented by the creditor, the debtor is entitled to all the benefits which he would have obtained if it had been performed by both parties.
Notes
Allows a debtor whose performance is prevented by the creditor to receive all benefits the debtor would have obtained if both parties had performed the obligation. Creditor-caused prevention therefore entitles the debtor to the benefits of full mutual performance rather than limiting recovery to the value of any partial performance.
