California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 1 — Nature of a Contract, Chapter 5 — Consideration, Section 1615

The burden of showing a want of consideration sufficient to support an instrument lies with the party seeking to invalidate or avoid it.

Notes

Requires the party seeking to invalidate or avoid an instrument for lack of consideration to prove that consideration sufficient to support the instrument is absent. The burden of proof therefore rests on the challenger rather than on the party seeking to enforce or rely on the instrument.
