California Codes, Civil Code - CIV, Division 3 — Obligations, Part 2 — Contracts, Title 2 — Manner of Creating Contracts, Section 1626

A contract in writing takes effect upon its delivery to the party in whose favor it is made, or to his agent.

Notes

Establishes that a written contract takes effect when it is delivered to the party in whose favor the contract is made or to that party’s agent. Execution alone therefore does not make the written contract effective under this rule without delivery to the beneficiary or authorized agent.
