California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 3 — Deposit, Chapter 1 — Deposit in General, Article 2 — Obligations of the Depositary, Section 1823

A depositary is not bound to deliver a thing deposited without demand, even where the deposit is made for a specified time.

Notes

Requires a demand before a depositary is obligated to deliver a deposited thing, even when the deposit was made for a specified period. The existence of a stated deposit term does not eliminate the requirement that delivery be demanded before the depositary becomes bound to return the deposited property.
