California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 3 — Deposit, Chapter 2 — Deposit for Keeping, Article 1 — General Provisions, Section 1833

A depositor must indemnify the depositary:

1. For all damage caused to him by the defects or vices of the thing deposited; and,

2. For all expenses necessarily incurred by him about the thing, other than such as are involved in the nature of the undertaking.

Notes

Requires a depositor to indemnify the depositary for damage caused by defects or vices in the deposited thing and for expenses necessarily incurred concerning it, except expenses inherent in the nature of the undertaking. The indemnity therefore covers the specified damage and necessary expenses while excluding costs already involved in undertaking the deposit.
