California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 3 — Deposit, Chapter 3 — Deposit for Exchange, Section 1878

A deposit for exchange transfers to the depositary the title to the thing deposited, and creates between him and the depositor the relation of debtor and creditor merely.

Notes

Defines a deposit for exchange as transferring title to the deposited thing to the depositary and creating only a debtor-creditor relationship between depositary and depositor. The depositor no longer retains title to the thing under this form of deposit; the statutory relationship created between the parties is debtor and creditor.
