California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 2 — Credit Sales, Chapter 1 — Retail Installment Sales, Article 1 — General Provisions, Section 1801.1

Any waiver by the buyer of the provisions of this chapter shall be deemed contrary to public policy and shall be unenforceable and void.

Notes

Bars a buyer from waiving provisions of the chapter by declaring any such waiver contrary to public policy, unenforceable, and void. The rule prevents the buyer and seller from making chapter requirements or protections ineffective through a waiver, because the provision gives an attempted buyer waiver no enforceable legal effect.
