California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 2 — Credit Sales, Chapter 1 — Retail Installment Sales, Article 4 — Restrictions on Retail Installment Contracts, Section 1804.4

Any provision in a contract which is prohibited by this chapter shall be void but shall not otherwise affect the validity of the contract.

Notes

Establishes a contract provision prohibited by the chapter as void while preserving the validity of the rest of the contract. The invalid prohibited term therefore does not, by itself, invalidate the entire agreement, and the remaining contract continues to have effect apart from the void provision.
