California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.7 — Consumer Warranties, Chapter 1 — Consumer Warranty Protection, Article 3 — Sale Warranties, Section 1795

If express warranties are made by persons other than the manufacturer of the goods, the obligation of the person making such warranties shall be the same as that imposed on the manfacturer under this chapter.

Notes

Requires a person other than the manufacturer who makes an express warranty on goods to assume the same obligation the chapter imposes on the manufacturer. The rule therefore applies the manufacturer’s chapter-based warranty duties to a nonmanufacturer that chooses to make an express warranty concerning those goods.
