California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 1.6 — Consumer Credit Reporting Agencies Act, Chapter 2 — Obligations of Consumer Credit Reporting Agencies, Section 1785.11.4

The provisions of Sections 1785.11.1, 1785.11.2, and 1785.11.3 do not apply to a consumer credit reporting agency that acts only as a reseller of credit information pursuant to Section 1785.22 by assembling and merging information contained in the data base of another consumer credit reporting agency or multiple consumer credit reporting agencies, and does not maintain a permanent data base of credit information from which new consumer credit reports are produced. However, a consumer credit reporting agency acting pursuant to Section 1785.22 shall honor any security freeze placed on a consumer credit report by another consumer credit reporting agency.

Notes

Exempts consumer credit reporting agencies acting only as resellers under the referenced provision from specified security-freeze sections when they merely assemble and merge other agencies’ data and keep no permanent database for new reports. Requires such a reseller to honor any security freeze another consumer credit reporting agency placed on the consumer’s report.
