California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 13 — Suretyship, Article 4 — Liability of Sureties, Section 2806

A suretyship obligation is to be deemed unconditional unless its terms import some condition precedent to the liability of the surety.

Notes

Establishes a suretyship obligation as unconditional unless the obligation’s terms create a condition precedent to the surety’s liability. A suretyship is therefore treated as imposing unconditional liability by default, with conditional treatment arising only when the terms themselves make fulfillment of a preceding condition necessary before liability attaches.
