California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 13 — Suretyship, Article 6 — Exoneration of Sureties, Section 2825

A surety is not exonerated by the discharge of his principal by operation of law, without the intervention or omission of the creditor.

Notes

Establishes that a surety is not exonerated merely because the principal is discharged by operation of law when the creditor neither intervened nor omitted an act causing that discharge. The surety therefore remains liable despite such a legal discharge of the principal when it occurs without creditor intervention or omission.
