California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 1 — Relief, Title 2 — Compensatory Relief, Chapter 2 — Measure of Damages, Article 1 — Damages for Breach of Contract, Section 3302

The detriment caused by the breach of an obligation to pay money only, is deemed to be the amount due by the terms of the obligation, with interest thereon.

Notes

Sets damages for breach of an obligation to pay money only as the amount due under the terms of the obligation, together with interest on that amount. The monetary recovery under this measure is therefore the contractually due sum plus interest, rather than a different measure of detriment.
