(a) This article applies to a contract entered into on or after January 1, 1999.
(b) This article does not apply to a retention withheld by a lender pursuant to a construction loan agreement.
Notes
Sets this article to apply to contracts entered into on or after January 1, 1999. Exempts from the article a retention withheld by a lender pursuant to a construction loan agreement, so that lender-held retention is outside the article despite the contract-date rule.
