California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 5 — Hiring, Chapter 2 — Hiring of Real Property, Section 1943

A hiring of real property, other than lodgings and dwelling-houses, in places where there is no custom or usage on the subject, is presumed to be a month to month tenancy unless otherwise designated in writing; except that, in the case of real property used for agricultural or grazing purposes a hiring is presumed to be for one year from its commencement unless otherwise expressed in the hiring.

Notes

Sets a month-to-month presumption for hiring real property other than lodgings or dwelling-houses where no custom or usage governs and the parties do not designate otherwise in writing. Sets a one-year presumption instead for property used for agricultural or grazing purposes, unless the hiring expresses a different term.
