California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 1 — Relief, Title 2 — Compensatory Relief, Chapter 2 — Measure of Damages, Article 4 — General Provisions, Section 3355

Where certain property has a peculiar value to a person recovering damages for deprivation thereof, or injury thereto, that may be deemed to be its value against one who had notice thereof before incurring a liability to damages in respect thereof, or against a willful wrongdoer.

Notes

Allows property’s peculiar value to a person recovering damages for its deprivation or injury to be treated as the property’s value against a person who had notice of that peculiar value before incurring liability. The same peculiar-value measure applies against a willful wrongdoer when damages are recovered for deprivation of or injury to the property.
