California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 3 — Deposit, Chapter 2 — Deposit for Keeping, Article 1 — General Provisions, Section 1840

Section Eighteen Hundred and Forty. The liability of a depositary for negligence cannot exceed the amount which he is informed by the depositor, or has reason to suppose, the thing deposited to be worth.

Notes

Limits a depositary's negligence liability to the value the depositor told the depositary the deposited thing had or the value the depositary had reason to suppose it had. The statutory cap therefore turns on the value communicated by the depositor or reasonably understood by the depositary, rather than an unstated higher value.
