California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 14 — Lien, Chapter 2 — Mortgage, Article 1 — Mortgages in General, Section 2942
Contracts of bottomry or respondentia, although in the nature of mortgages, are not affected by any of the provisions of this Chapter.
Notes
Exempts contracts of bottomry or respondentia from the chapter containing this rule, even though those contracts are in the nature of mortgages. Their mortgage-like character does not bring them within the chapter; the provision expressly leaves bottomry and respondentia contracts unaffected by its requirements.
