California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 3 — Nuisance, Title 2 — Public Nuisances, Section 3490

No lapse of time can legalize a public nuisance, amounting to an actual obstruction of public right.

Notes

Bars any lapse of time from legalizing a public nuisance that amounts to an actual obstruction of a public right. The prohibition applies whenever the nuisance constitutes that actual public-right obstruction, so passage of time cannot transform the obstructing public nuisance into a lawful condition or eliminate its status as a public nuisance.
