California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 5 — Hiring, Chapter 6 — Assignment and Sublease, Article 2 — Restrictions on Transfer, Section 1995.220
An ambiguity in a restriction on transfer of a tenant’s interest in a lease shall be construed in favor of transferability.
Notes
Requires ambiguity in a restriction on transfer of a tenant’s interest in a lease to be construed in favor of transferability. When the restriction’s meaning is ambiguous, the interpretive rule favors allowing transfer of the tenant’s lease interest rather than construing the ambiguity against transferability.
