California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 7 — Carriage, Chapter 5 — Common Carriers, Article 3 — Common Carriers of Property, Section 2196

Section Twenty-one Hundred and Ninety-six. A common carrier is liable for delay only when it is caused by his want of ordinary care and diligence.

Notes

Limits a common carrier's liability for delay to delays caused by the carrier's lack of ordinary care and diligence. Makes want of ordinary care and diligence the stated condition for delay liability, so liability under this rule attaches only when the carrier's failure to exercise that level of care causes the delay.
