California Codes, Civil Code - CIV, Division 3 — Obligations, Part 4 — Obligations Arising from Particular Transactions, Title 7 — Carriage, Chapter 5 — Common Carriers, Article 4 — Common Carriers of Messages, Section 2208

A common carrier of messages, otherwise than by telegraph, must transmit messages in the order in which he receives them, except messages from agents of the United States or of this State, on public business, to which he must always give priority. But he may fix upon certain times for the simultaneous transmission of messages previously received.

Notes

Requires a nontelegraph common carrier of messages to transmit messages in the order received, but gives priority to public-business messages from agents of the United States or California. Allows the carrier to set particular times for simultaneous transmission of messages already received, creating an exception to immediate sequential transmission without changing the stated priority.
