California Codes, Civil Code - CIV, Division 4 — General Provisions, Part 3 — Nuisance, Title 2 — Public Nuisances, Section 3495

Any person may abate a public nuisance which is specially injurious to him by removing, or, if necessary, destroying the thing which constitutes the same, without committing a breach of the peace, or doing unnecessary injury.

Notes

Allows a person specially injured by a public nuisance to abate it by removing or, when necessary, destroying the thing constituting the nuisance. The person must act without breaching the peace or causing unnecessary injury, so self-help abatement is limited by those express constraints on how the nuisance may be removed.
